Robert Cover and Bushrod Washington

On Wednesday I participated in a workshop at NYU hosted by Bill Nelson, a mentor to so many legal historians, on my book project on Bushrod Washington. One of the many excellent suggestions was that I should look again at Robert Cover’s classic book Justice Accused, which looked at how judges dealt with slavery. The closing line of the book is especially apt in describing Justice Washington:

“If a man makes a good priest, we may be quite sure he will not be a great prophet.”
