This is the title of a new article that I’ve started writing. Basically, I’m going to take the ideas from my first two books (on Jacksonian Democracy and William Jennings Bryan) and apply them to constitutional developments since President Obama was elected in 2008. We are in a kind of limbo right now between the Reagan Revolution and the Obama Administration. The Democrats won a huge victory in 2008 and enacted the Affordable Care Act, but the GOP now holds the House and there is still a slim conservative majority on the Court. How will this play out? What can prior constitutional transitions or stalemates tell us about this?I’ll have more to say about that in the coming months.
