The Spending Clause

I will throw out one more thought about the health care decision.  I think that NFIB is likely to become the Lopez of the Spending Clause. In other words, lots of people will try to use it to challenge the conditional use of federal funds, but the odds that it gets invoked again (or, say, more than once) are long.
