John Marshall’s Nomination

One of our readers, Daniel Rice, sent me this picture that he took at the National Archives.  It is President Adams’ nomination of John Marshall to be Chief Justice.  I love how the nomination is framed as a second-best choice (John Jay said no, so I guess I have to pick this guy.)

    There had been three already in just 11 years, so maybe Adams didn’t expect Marshall to stick around for long.

    Let’s see, what was it Marshall forgot to do before he was sworn in? If he hadn’t forgotten, he might not have had the opportunity to lay down a foundational decision of the Court in his early years as Chief.
