Regarding Norton’s “The Supreme Court’s Post-Racial Turn Towards a Zero-Sum Understanding of Equality”, such a zero sum understanding is hardly contingent on assuming we’ve reached a post-racial state. It merely relies on understanding equality of rights as being the equality guaranteed by the Constitution, not equality of outcomes.
